I, participant, hereby affirm that I am aware of and understand there are inherent hazards associated with underwater photography and/or modeling which may result in serious injury or death. I understand there are certain risks associated with aquatic activities conducted in and around a swimming pool or confined or open water activity sites, and I expressly assume the risk of said injuries. I understand that these activities will expose me to these risks. The activities of underwater photography and modeling have risks similar or the same as Freediving and/or SCUBA Diving, depending on the equipment I freely choose to use during this event. I agree that I have received all the proper training and have experience using the equipment and techniques I plan to employ with respect to Freediving and SCUBA. I further understand that this activity may be conducted at a site that is remote, either by time or distance or both from medical services. I still choose to proceed with this activity in spite of the absence of medical services in proximity to the activity site. I understand and agree that neither the hosts conducting this activity, nor the facilities through which this activity is conducted, Kimber Greenwood, the Underwater Creatives Academy LLC, nor any of their respective employees, officers, agents, event sponsors, or assigns (hereinafter referred to as "Released Parties") may be held liable or responsible in anyway for any injury, death or other damages to me, my family, our heirs or assigns that may occur as a result of my in this activity or as a result of the negligence of any party, including the Released Parties, whether passive or active. I further understand that these activities can be a physically strenuous activity and that I will be exerting myself during this activity and that if I am injured as a result including heart attack, stroke, panic, hyperventilation, pre-mature labor, etc., that I expressly assume the risk of said injuries. I affirm that I will not hold the above listed individuals or companies responsible for the same. In consideration of my participation in this activity I hereby personally assume all risks in connection with the activity for any harm, injury, or damage that may befall myself or a family member while participating in the activity, including all risks connected therewith, whether foreseen or unforeseen. I further release and hold harmless said activity and the Released Parties from any claim or lawsuit by me, or my family, or our estate, heirs, or assigns, arising out of my participation in this activity. I understand and agree this Release is divisible, and any portion herein held to be in violation of any applicable statutes, laws, or regulations or any governmental agency having jurisdiction shall affect only that portion held to be invalid or inoperative, and the remaining portions of this Release shall remain in full force and effect. I further state that I am of lawful age and legally competent to sign this Assumption of Risk and Liability Release Agreement, and as a consenting adult, am providing written consent of my participation. I understand that the terms herein are contractual and not a mere recital and that I have signed this Release of my own free act.
I, PARTICIPANT, BY THIS INSTRUMENT DO EXEMPT AND RELEASE THE HOST AND PROFESSIONALS CONDUCTING THIS ACTIVITY, THE FACILITIES THROUGH WHICH THIS ACTIVITY IS CONDUCTED, ANY SPONSORS, AND ALL RELATED ENTITIES AS DEFINED ABOVE, FROM ALL LIABILITY OR RESPONSIBILITY WHATSOEVER FOR PERSONAL INJURY, PROPERTY DAMAGE, OR WRONGFUL DEATH, HOWEVER CAUSED, INCLUDING BUT NOT LIMITED TO THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE. I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS ASSUMPTION OF RISK AND LIABILITY RELEASE AGREEMENT BY READING IT BEFORE SIGNING IT ON BEHALF OF MYSELF, MY FAMILY, AND MY HEIRS.
I, participant, understand that my spot for this event is not reserved until I have made the first payment. Because of the nature of educational events, there are no conditions in which your spot and payment would be refunded to you unless the event is canceled by the Underwater Creatives Academy, the host, or we do not meet our minimum requirements to run the event. These events are highly time intensive for our team and very limited in spots. We highly recommend purchasing travel insurance if you are coming from out of town to cover you in case of an unforeseen need to cancel. Please note that everything is weather dependent and changes to the event may be necessary due to unforeseen circumstances. Additionally, I understand that refunds will not be provided if I am not able to meet the minimum medical requirements to attend. The Underwater Creatives Academy recommends reviewing all medical requirements BEFORE registering, and seeking any physician approvals as necessary if YES is answered to any of the above questions.
In the event I, participant, am forced to cancel my attendance at the event I understand that the following options are applicable. I can request the balance paid be applied to a future event, educational opportunity, or photoshoot, or I can find an individual to take my place at the event. Any substitutions must be approved by the Underwater Creatives Academy (UWCA) before confirmation of the spot transfer. I understand that due to the nature of the specific event, or due to past experiences, an individual may not be approved as a substitute and another may need to be identified. In the event of a refund due to transfer or cancellation by the participant that UWCA determines is eligible for a partial or full refund will be made with a reduction for the costs of payment processing fee, which are not refunded to us by payment services. The reduction is typically 3% of the payment received however may be adjusted based on the payment made (i.e. foreign transaction fees outside the USA may have higher processing fees).
By attending this event, I acknowledge and agree that Underwater Creatives Academy and Water Bear Photography (or their authorized representatives) may capture photographs, video recordings, and other media during the event. I understand that my likeness, image, and voice may be included in this content. I hereby grant Underwater Creatives Academy and Water Bear Photography irrevocable permission to use, reproduce, publish, distribute, and display such content, in whole or in part, for any lawful purpose, including but not limited to advertising, marketing, promotional materials, and other commercial uses, across all media now known or hereafter developed, without further compensation or notification to me. I waive any right to inspect or approve the finished product wherein my likeness appears. If I have any concerns about being photographed or video recorded, you agree to speak with the event host upon or prior to arrival.
